Mondiaz B.V. commits to packaging the goods properly and securing them in such a way that they reach their destination in good condition under normal transportation.
Delivery times are estimated. The delivery period begins once all technical details have been agreed upon and all necessary information for the execution of the delivery is in the possession of Mondiaz B.V. If agreed, the delivery period also begins once Mondiaz B.V. has received the agreed (partial) payment or satisfactory payment security has been provided.
The delivery time is set with the expectation that Mondiaz B.V. can continue operations as anticipated at the time of the offer and that the necessary materials will be delivered on time. Exceeding the delivery time can only lead to compensation if explicitly agreed in writing. In other cases, Mondiaz B.V. is not liable for damages due to late performance unless mandatory legal provisions dictate otherwise.
Goods will be delivered by Mondiaz B.V. to the agreed location in the Netherlands, free of charge, for a minimum order amount of net €500. Exceptions include set prices, which always include transport costs. Mondiaz B.V. reserves the right to ship the goods at transport costs to the buyer. Immediately after delivery, the buyer assumes the risk of all direct and indirect damages arising from or caused by the delivered goods or parts thereof.
All goods travel at the risk of Mondiaz B.V. from the moment of dispatch and are insured, unless Mondiaz B.V. has explicitly agreed otherwise with the buyer.
Ex-works delivery is also possible if agreed upon by both parties. In this case, all goods travel at the buyer's risk from the moment of dispatch, and the buyer must insure the goods in advance, unless Mondiaz B.V. has explicitly agreed otherwise with the buyer.
If the goods cannot be shipped due to circumstances for which Mondiaz B.V. is not liable and which are attributable to the buyer, Mondiaz B.V. will be deemed to have fulfilled its delivery obligation by making the goods available to the buyer, provided that it has notified the buyer within three working days after the goods have been offered for delivery. In such a case, the payment term starts on the day the delivery would have actually taken place.
1938
